Terms
Terms of use
The terms on which this website is provided. They are short, because this website does very little: it explains what the Centre does and how to reach it.
1. Who operates this website
This website is operated by the Tenure Support Centre, an action-research initiative run jointly by the Centre for Affordable Housing Finance in Africa (CAHF) and 71point4, working from the FNB Khayelitsha Mall in Cape Town, South Africa. “We” and “us” below mean the Centre.
2. Using this website
You are welcome to read, print and share anything on this website for your own use or for non-commercial purposes, provided you do not change what it says and you do not present it as your own.
You may not use this website in a way that damages it or interferes with access to it for anyone else, or attempt to gain access to any part of it that is not intended for public use.
3. What this website is not
This is important, so it is stated plainly:
- Nothing here is legal advice. It describes what the Centre does in general terms. Whether a particular property can be transferred, and how, depends on the facts of that property and on the law at the time. For advice on your own situation, speak to us or to a conveyancer or attorney.
- Reading this website does not open a case. The Centre takes on cases through its office in Khayelitsha. A case exists when we have opened a file, and not before.
- We are not the deeds office, the City, or a court. We cannot decide the outcome of a transfer, and nothing on this website should be read as a promise that any particular result will be achieved.
4. Accuracy
We try to keep this website accurate and current. Reports, toolkits and studies are accurate as at the date they were published, which is stated in each of them. Property law, municipal process and government programmes change, and material that was right when it was written may not be right now.
If you find something here that is wrong or out of date, please tell us — we would rather correct it than leave it.
5. The contact form
The form on the contact page does not send anything to us and does not store anything. It arranges what you have typed into an email and opens it in your own email program, so that you can read it and send it yourself. Until you do, we have not received it and do not know it exists. See the privacy policy for more.
6. Links to other websites
This website links to a small number of other sites — the Centre's project library on CAHF's website, and the Information Regulator. We do not control those sites and are not responsible for what they contain or for how they handle your information. A link is not an endorsement.
7. Copyright and reuse
The text on this website, and the Centre's name and marks, belong to the Centre and its partners. The reports, toolkits and learning material referenced in the publications list are published for public use — they exist to be used by people working on housing.
If you want to reproduce one of them, in whole or in part, write to us first. We are likely to say yes, and we would like to know where the material is going.
8. Liability
This website is provided as it is. We do not promise that it will always be available, that it will be free of errors, or that the information on it is suitable for any particular purpose.
To the extent the law allows, the Centre and its partners are not liable for any loss arising from reliance on information published on this website, or from this website being unavailable. Nothing in these terms limits any right you have under the Consumer Protection Act or any other law that cannot be excluded.
9. Governing law
This website is provided under the laws of the Republic of South Africa, and any dispute about it is subject to the jurisdiction of the South African courts.
10. Changes
We may change this website, and these terms, from time to time. The terms in force are the ones published on this page at the time you use the site.
